Statement Regarding Repeal of Colorado Tobacco Preemption

The American Lung Association in Colorado applauds the State Legislature and Governor Polis for signing into law HB 1033, which will give cities and counties the authority to protect the health of their citizens by passing local tobacco control laws.

Local governments are closest to the residents of this state and will now be able to assess whether additional restrictions on tobacco sales are needed in their communities to protect our kids from tobacco.

Specifically, this law will allow localities in Colorado to pass effective local Tobacco 21 laws that include licensing of tobacco retailers, which helps hold them accountable for preventing tobacco sales to our kids. The law would also allow localities to enact local taxes on cigarettes in addition to the state tax on cigarettes.

The American Lung Association looks forward to working with communities across Colorado to push forward with initiatives to combat the number one cause of preventable death and disease in the state, tobacco.
